A federal judge has ruled that the administration of former President Donald Trump can continue its measures to withhold millions of dollars earmarked for hotel accommodations for migrants in New York City.
The decision came from District Judge John McConnell in Rhode Island. He found that the government’s decision to hold back Federal Emergency Management Agency (FEMA) funds intended for New York was not subject to an ongoing order aimed at preventing a broad cessation of federal funding by Trump’s administration.
Judge McConnell noted, “Since the defendants seek to end funding based on applicable statutes, regulations, and authorizing terms, there is no perceived need for further clarifications.” He denied a request for an emergency hearing on the matter and upheld a temporary restraining order that stops the freezing of funds.
On Monday, Elon Musk, who heads the Department of Government Efficiency under Trump, revealed that his team discovered that funds meant for disaster relief had been used to pay for luxurious hotel accommodations for migrants. Musk and the Department of Government Efficiency (DOGE) have been streamlining operations across the federal government, focusing on cutting costs and reducing the workforce.
The next day, four federal employees were fired after officials from the Department of Homeland Security stated that those individuals had bypassed management to execute these payments. These expenditures have become commonplace through a program established to help cover costs due to an increase in migration.
Interim FEMA Administrator Cameron Hamilton stated in court documents that the Republican administration pulled funds from the Refugee and Services Program out of concern that the money was enabling illegal activities at a Manhattan hotel that was housing migrants.
In 2023, New York began leasing the Roosevelt Hotel as a reception center for homeless migrants seeking city services. The hotel had been closed since the fall of 2020 due to the COVID-19 pandemic. City law mandates that New York must provide shelter to anyone who requests it, and at that time, the regular shelter system was overwhelmed by the influx of new migrants. The hotel now serves as both a location for migrants to apply for services and as temporary housing for hundreds of families, who can stay for up to 60 days.
Hamilton explained that the federal government reserves the right to pause or end payments if recipients do not comply with the program’s terms. FEMA has reached out to New York for further information to ensure that federal funds are not being misused for illegal activities.
The Refugee and Services Program, funded by Congress and managed by FEMA, has faced criticism from Republicans. They argue, often inaccurately, that it diverts funds away from victims of hurricanes and flooding.
