A federal appeals court has sided with the Trump administration, ruling that the government can continue to detain some immigrants while their cases are processed. This decision is a win for those who believe in strong border security and upholding the law.
The 5th Circuit Court of Appeals decided that the Department of Homeland Security is within its rights to deny bond hearings to immigrants who are arrested in the country. The court said that the government is correctly following the Immigration and Nationality Act. According to this act, immigrants who haven’t been officially allowed into the country can be detained, no matter how long they’ve been here.
In the past, many immigrants without criminal records were allowed to ask for a bond hearing, where a judge would decide if they could be released while waiting for their court date. This was especially true for those arrested away from the border. However, the Trump administration changed this policy, believing that stricter enforcement is needed.
A judge who disagreed with the ruling argued that the law shouldn’t be interpreted to allow the detention of so many people, including those with families who are American citizens. But supporters of the administration’s policy argue that past administrations were too lenient and that the government has the authority to enforce the law more strictly.
U.S. Attorney General Pam Bondi praised the court’s decision, saying it helps to keep America safe. She stated that the administration will continue to fight for strong law enforcement in court.
