Las Vegas – Lawyers for Duane “Keffe D” Davis, the man accused in the 1996 killing of Tupac Shakur, are trying to block evidence. They say it was found during an “unlawful” night search.
Davis’s lawyers, Robert Draskovich and William Brown, say the judge was wrong to allow the night search. They claim the judge thought Davis was a dangerous drug dealer, but this was not true. Night searches should only happen when there is a real risk that evidence will be lost if police wait until morning.
The lawyers argue that Davis, a former gang member, left the drug trade in 2008. They say he started working in oil refineries. At the time of the search, he was a 60-year-old retired cancer survivor living with his wife in Henderson, Nevada, for nine years. He also had adult children and grandchildren.
His lawyers wrote that the court did not know any of this. They claim the court only saw a false picture of Davis when they approved the night search.
The Las Vegas police, who did the search, declined to comment. But, they said the night search was needed to secure the area and protect residents.
Davis was arrested in September 2023. He has pleaded not guilty to first-degree murder.
His lawyers claim Davis only got arrested because he lied and said he was in the car when Shakur was shot. They say he has never given real details to prove he was there. They argue that he lied to avoid drug charges and make money from documentaries and a book.
Davis tried to get his murder charges dropped in the Nevada Supreme Court, but this was denied.
His lawyers said that Shakur’s murder is like the JFK assassination for the entertainment world. They said it is easy to see why someone like Davis would lie about being involved to get attention and money.
