A judge has turned down a request from the soon-to-be ex-husband of singer Sia for immediate custody of their young son, Somersault. Dr. Daniel Bernad claimed Sia’s behavior was “reckless” and that she was not fit to care for their child due to alleged substance abuse issues.
Sia responded by saying that Bernad had rarely spent time alone with their son. She also brought up an old investigation involving Bernad and alleged “illicit child pornography” found on his computer.
The judge decided that there wasn’t enough evidence to take immediate action. They noted that the couple already had an agreement in place for custody since August. The judge said Bernad could bring up the issue again in court later.
Bernad also claimed that Sia had hidden a two-week hospital stay from him, during which she supposedly tested positive for certain drugs without a valid medical reason. He also accused her of giving temporary power of attorney over their son to her nannies, which he said broke their custody agreement.
Sia denied the claims, stating she has been sober for over six months and has offered to take drug tests to prove it.
The couple is in the middle of a divorce, which Sia started in March, citing disagreements that couldn’t be resolved.
