Lululemon has taken legal action against Costco, alleging that the wholesale retailer is selling cheaper copies of its popular athletic wear. In a lawsuit filed in California, Lululemon claims that Costco is unfairly benefiting from its well-established brand by selling unauthorized apparel that mimics Lululemon’s designs and patents.
The company points out that Costco often collaborates with manufacturers of well-known brands for its Kirkland label. However, Lululemon argues that many consumers mistakenly believe these Kirkland products are made by the original brand, thanks to Costco’s lack of transparency about this relationship.
A spokesperson from Lululemon emphasized the importance of protecting intellectual property and announced their commitment to taking legal action when necessary.
Among the items in dispute are Lululemon’s popular Scuba hoodies, Define jackets, and ABC pants. For instance, one of Costco’s offerings, the Hi-Tec Men’s Scuba Full Zip, is priced at $19.97, while Lululemon’s versions cost over $100 each.
Costco, based in Washington state, has not commented on the lawsuit as of now. Lululemon is seeking a jury trial to prevent Costco from selling these products and is also looking for financial compensation.
This isn’t the first time Lululemon has faced legal challenges. In 2021, the company was involved in a lawsuit with Peloton, but two years later, both companies announced a partnership that solidified Lululemon as Peloton’s primary apparel partner.
