Emilie Kiser’s Legal Team Seeks to Protect Details of Son’s Drowning Case
Emilie Kiser is taking steps to limit the release of information regarding the tragic drowning of her 3-year-old son, Trigg, on May 12. Her legal team has filed a motion to redact certain details from a police report that point to why authorities suggested her husband, Brady Kiser, face charges of child abuse.
On July 25, the Maricopa County Attorney’s Office announced that there was “no likelihood of conviction” against Brady, which marked a significant development in the ongoing case. Emilie had previously sought court intervention on May 27 to keep records about her son’s death private, expressing concerns over the public interest in the tragic event.
The new motion filed by Emilie’s lawyers aims to remove sensitive information from two pages of the Chandler Police Department report. Attorney Matthew Kelley stated that Emilie is worried that public access to these details could lead to “disturbing” representations of the incident, potentially using technologies like artificial intelligence.
Kelley explained that the redacted sections contain crucial context that informs the public about the investigation and the decisions made by law enforcement and the attorney’s office regarding charges.
In addition, Emilie previously won a legal motion on June 3 that allowed her personal declaration related to the case to remain private. This declaration was described as a deeply personal account of her grief, intended for the court’s understanding rather than public consumption.
A source remarked that while Emilie’s request for privacy is important, it doesn’t obstruct the public’s ability to grasp the case’s key legal aspects. This approach is viewed as both reasonable and compassionate given the circumstances surrounding the family’s loss.
