A federal court has turned down a complaint against Judge James Boasberg, a judge in Washington, D.C. The complaint, made by the Justice Department, said Judge Boasberg acted wrongly.
The Justice Department said Judge Boasberg made comments at a meeting that showed he was against the Trump administration. They said he suggested the Trump administration would cause a “constitutional crisis” if it didn’t follow court rulings. These comments were made just before Judge Boasberg stopped some deportation flights.
However, Chief Judge Jeffrey S. Sutton of the Sixth Circuit Court of Appeals said the government didn’t give enough proof of Judge Boasberg’s comments or the situation around them. He dismissed the complaint on December 19.
Judge Sutton said that just repeating claims without showing where they came from is not enough to prove them. He also said that repeating claims that haven’t been proven doesn’t make a good reason for a misconduct complaint.
This news comes as the White House has said it supports the Senate’s investigation into Judge Boasberg and another judge who Republicans say is an activist.
A White House official said that some judges are going too far and hurting the rule of law to push their own ideas. The official said this needs to stop and that the White House supports efforts to look into these judges.
The official also said that President Trump should be able to carry out the plans he promised to the American people. They said that judges who make biased rulings are abusing their power and are not being fair.
Republicans have been critical of Judge Boasberg because of his decisions on immigration policies during the Trump administration. These decisions included cases about moving migrants to other countries instead of keeping them in U.S. detention.
Recently, Judge Boasberg faced more criticism after reports said he approved warrants that allowed investigators to get phone records connected to some Republican lawmakers.
