New York City is taking legal action against the Trump administration concerning the recent withdrawal of $80.5 million in federal funding designated for migrant shelter assistance. This lawsuit, filed in the U.S. District Court for the Southern District of New York, accuses the federal government of “unlawful money grab,” claiming that these funds were taken without prior notice to city officials.
The federal funding in question was intended to help New York City and other local governments manage the costs associated with a significant increase in migrant arrivals. Mayor Eric Adams expressed strong discontent over the abrupt removal of these funds, stating that while the immigration system is flawed, it is unreasonable for one city to bear the majority of the costs stemming from a national crisis.
“New York City has skillfully managed an unprecedented challenge, having welcomed over 231,000 individuals seeking shelter. The $80 million we were promised and then suddenly had taken back was the least we could have expected, particularly after spending over $7 billion in related expenses over the past few years,” Mayor Adams declared. He assured residents that his administration would work diligently to reclaim the funds owed to the city.
The lawsuit names several high-level officials, including former President Trump and current leaders within the Department of Homeland Security and the Treasury. The sudden shift in funding took place on February 11, leaving city officials unaware until the following day when the city’s Comptroller, Brad Lander, publicized the missing funds and labeled the action as “highway robbery.” Adding fuel to the fire, billionaire entrepreneur Elon Musk suggested that his department uncovered substantial waste in how relief funds were allocated, particularly pointing to the use of luxury hotels to shelter migrants.
In response to escalating financial burdens caused by this migrant situation, New York City had sought and received two separate grants totaling approximately $80.5 million during the Biden administration. These funds were made possible through the Shelter and Services Program, which Congress had authorized with a total budget of $650 million in 2024. This funding aimed to provide reimbursement for expenses incurred by local governments in their efforts to house and assist the influx of migrants crossing from the U.S.-Mexico border.
City officials noted that these FEMA funds were designed to provide a reimbursement of $12.50 per night for hotel accommodations, and they clarified that the majority of the hotels housing migrants are not luxury establishments. In addition to lodging, the remaining funds were earmarked for essential services, including security and food.
As the situation unfolds, City Comptroller Brad Lander, who also aims to challenge Mayor Adams in the forthcoming Democratic primary, stated that pressure was effectively applied to ensure the lawsuit against the federal government was initiated. He praised the city’s legal team for taking action to recover the funds and criticized President Trump for what he described as stealing from the city.
Concerns have also emerged among local lawmakers regarding Mayor Adams’ leadership, particularly following reports of a dismissal of a federal corruption case against him, which prompted calls for his resignation. A top federal prosecutor’s abrupt resignation has raised questions about the integrity of the political dealings related to the ongoing immigration situation in New York City.
The relationship dynamics between City Hall and the Trump administration appear increasingly complex, especially with several deputy mayors reported to have resigned. Critics allege that there may be an improper alignment between the mayor and the former president’s directives, distracting the administration from its obligations toward the citizens of New York.
As the lawsuit progresses, the city continues its fight to reclaim the funds that it believes are crucial for its management of the migrant crisis. The White House has yet to offer a comment regarding the city’s claims.
