Lee suggested that if Casey continues to rely on what he termed “illegal votes,” the Senate might have grounds to refuse to seat him. This exchange comes amidst a contentious Senate race in Pennsylvania, currently undergoing a recount. Republican candidate Dave McCormick won by approximately 26,000 votes, per the threshold in Pennsylvania law that calls for an automatic recount when the margin is within one percent.
Despite news outlets declaring McCormick the winner, Casey has not accepted the results, insisting that the counting should continue until every vote is accounted for. However, there are concerns over the validity of some ballots, particularly after a ruling by the Pennsylvania Supreme Court deemed that ballots missing signatures and dates should not be counted. Democratic officials in areas like Philadelphia and its suburbs appear to be disregarding this ruling.
Some Democratic leaders are openly discussing their plans to continue counting questionable ballots, raising alarms about potential violations. Commissioner Diane Ellis-Marseglia of Bucks County expressed a disregard for court precedents, indicating a willingness to flout laws to ensure every vote is counted.

Senator Lee has urged Casey to step aside and allow McCormick to assume his role in the Senate, calling for Casey to act honorably.
